Purchase Terms

Whilst every effort has been made to ensure that the information contained on this website and in our catalogues is accurate and up to date, Just Fitness cannot be held liable for any errors, omissions or price changes. Due to continuous product development, specifications & colours may change.

Please consult your Doctor before using any product.

All products are subject to availability.

All products are delivered flat packed and will require some assembly unless prior arrangements are made with the store.

Placing Your Order

Please note that in all cases we must have a valid contact telephone number for you. We will not be able to process your order without this information. Also, couriers may not deliver parcels without contact phone details.

We have 3 methods for you to place your order. Telephone, in store and Online. All orders must be paid for in full before they will be shipped or ordered from the supplier. This includes any item that is put on backorder for you if it is out of stock.

Deliveries

Please note: Due to Health & Safety regulations deliveries above or below ground floor are at the carriers discretion and are not guaranteed. This includes (but not limited to) steps that are immediately outside the premises, which are required to climb in order to gain access to the property.

All orders are processed and shipped in the order that they are received. Normal delivery time is 5 to 7 working days but please allow upto 14 days to accommodate any possible delays. Delivery times may also increase around holidays, during peak shipping seasons or if you live in a remote country area. The freight delivery service you receive may vary among carrier companies. Please note: Freight couriers are one person operators and due to safety regulations do not deliver inside homes. Delivery is typically made to the front door if it is reasonably easy to access. This is at the drivers discretion. Large fitness items typically weigh in excess of 60kg+ and will require customer assistance when delivered. If the customer requires a tailgate this will incur an additional charge payable before delivery.

Be sure to include one or two phone numbers in case the carrier needs to notify you to arrange delivery. All deliveries are made Monday - Friday between 9am & 5pm. Our carriers are unable to give specific times for delivery.

Please also note that if you are in a remote area, delivery may only be made to the nearest depot. Collection will then need to be made by the customer from the depot.

Delivery / Click & Collect (Purchase Items Only)

Just Fitness offers delivery Australia Wide. Some items displaying Click & Collect options are only available for a free pick up from our store locations. Other details are as follows:

Delivery is to front door, ground level only - Drivers typically aren’t insured to take large items upstairs.
For heavier items, the couriers may request the use of truck with a tailgate. This may incur an extra charge which will be the responsibility of the customer to pay.
Item leaves within 2 - 3 days of payment & delivery is made within 14 days of despatch although most of the time it is quicker (5-7 days).
If you're not available at the time of delivery, re-delivery charges may be applicable for subsequent attempts to deliver.
All items are delivered flat packed and require assembly.
For heavy items driver may need some assistance or the courier may require a tailgate which may incur a fee to the customer.

Late Deliveries

We or our carriers will always try to arrive on time, but will not be held responsible for late arrival due to unforeseen circumstances.

Short Deliveries and Damage to Packaging

When the delivering carrier brings your order you MUST count the pieces you receive and look for any damage to the packaging. It is noted on the carrier's delivery note, the number of boxes you should receive. If the number of boxes you receive does not exactly match the number of pieces on the carrier's delivery note, you MUST note the number of pieces you received on the delivery note by your signature. Damage to packaging MUST be noted on the delivery note next to your signature. You must cross out "delivered in good condition" from the carrier's delivery note. It is very important to check your order. A signature is an acceptance that you have received the whole order & that the packaging was in good condition.

Any short delivery of boxes (missing boxes) must be reported to Just Fitness within 48 hours of signing. Neither Just Fitness nor the delivering carrier can be held responsible for short deliveries or damages to packaging if you do not note them on your delivery note. This does not affect your statutory rights in the event of the goods being faulty. The customer is asked to examine the goods as soon as reasonably possible after delivery and notify us of any fault or damage as soon as reasonably possible.

Hire / Rental Terms

The Hire/Rental Terms are only applicable on Hire Products under their respective Hire Categories. All products are not available to hire. Please refer to the Hire links on the main menu.

These terms are in addition to Just Fitness' company policies and general terms and conditions.

Equipment

The descriptions and images of the Equipment and on the Site are for illustrative purposes only. They are generic models and every effort has been made to describe the features and dimensions fairly. If any particular feature or attribute is critical to you, please let us know.

Personal & Payment Information

As part of the contract, Just Fitness requires to keep your contact and payment method information on file which includes Name, Address, Email, Contact Number, Drivers Licence Details and Credit Card Details for security reasons. The information is kept secure and is securely destroyed once the hire term has terminated and the item is returned. As part of Just Fitness privacy policy, the details are not disclosed to any third party.

Contract Formation

After an Order has been placed, the Hirer will receive an e-mail acknowledgment. The acknowledgement does not mean that an Order has been accepted. An Order will only be accepted upon signing the Hire Agreement.

Equipment Hire and Rental Period

The Hirer shall hire the Equipment subject to these Terms:

Just Fitness shall not, other than in the exercise of its rights under these Terms or applicable law, interfere with the Hirer's quiet possession of the Equipment.
The hire term begins once the Hirer has received the equipment.
The Contract shall continue until terminated in accordance with these Terms.
The hirer agrees to pay for any loss or wilful damage to the equipment and authorizes Just Fitness to charge the hirer as such. This includes cleaning.

Rental Charges

The minimum Rental is as described in the description or Hire Options are per the website.
The Rental Fee shall be payable in advance for the whole term.
The Rental Fee is set on Automatic Renewal and once the hire term is over, it is automatically renewed as per the original hire cost and original terms and conditions. Just Fitness needs to be notified atleast 2 days prior to completion date via email sent to mandy@justfitness.com.au that the hire contract will be terminated or renewed.
It is the responsibility of the Hirer to advise Just Fitness if they do not wish to Re-Hire before the end of the original Hire period finishes. At the successful termination of the Hire term, Just Fitness will organize a day and time for the items to be collected.
If the Hirer does not make the Equipment available for collection on termination of the Contract, the Hirer shall be responsible for the Rental Fee until the Equipment is collected by Just Fitness. If the equipment has been booked in and the Hirer is not available at the time of pickup, Just Fitness is entitled to charge a re-booking fee for the pickup of the equipment.
Early Termination of the Hire Agreement does not entitle the Hirer for any refund and hence any remaining time left on the hire is forfeited.
The Rental Fee is inclusive of GST, Delivery, Installation and Pickup charges.

References

Prior to accepting any Order, Just Fitness may at its complete discretion request references, proof of identity and proof of residence of a Hirer. The Hirer expressly acknowledges and agrees to such requests and checks being made by Just Fitness.

Acceptance

The Hirer shall satisfy himself that the Equipment supplied by Just Fitness corresponds to the Order and is in working order. Any part of the Equipment found to be faulty, or not found to correspond with the Order, shall be notified to Just Fitness immediately.

Suitability

It is the Hirer’s responsibility to ensure that the Equipment is, if necessary, compatible with existing installations, and is suitable for all of the Hirer’s requirements. Choosing the unsuitable equipment does not entitle the Hirer to a refund.

Substitution

Just Fitness reserves the right to substitute the Equipment proposed for the Rental with alternative equipment of an equal or higher specification. On termination of the Contract, the Hirer may not substitute any Equipment delivered by Just Fitness.

Delivery & Pick Up

Whilst all care is taken, Just Fitness accepts no responsibility for any accidental damage caused during the course of delivery or pickup. The equipment is delivered by Just Fitness and Pickup is NOT AVAILABLE from any of our locations. Due to Occupational Health & Safety, the delivery service is to ground floor only and due to the nature and size of the items, the delivery drivers cannot take items upstairs and may require customer assistance if needed. If the item is required to be taken upstairs, the customer will be charged extra due to needing extra delivery personnel to accommodate the request. For deliveries outside the "Melbourne Metropolitan Zone" as mentioned on the “Hire Shipping Zone” tab on the hire product, there will be an extra delivery surcharge applicable depending on the distance. Once the order has been processed and booked for delivery or collection, any cancellation from the Hirer will incur a CANCELLATION CHARGE OF $30. If re-booking is required, a RE-BOOKING CHARGE OF $30 will also apply.

Hire To Own

Only the first hire term fee is deducted from the Original Purchase Price of the item if the hirer decides to purchase the hired equipment. This does not include any Sale or Promotional price the item may be on. The intent of purchase must be notified within 7 days of the completion of the hire period or before the equipment has been booked for a pickup. Whichever comes first. If you’re not sure about the price of the item, please contact the Hire Department.

ATTENTION: Just Fitness does not take any responsibility for personal injury, fatigue or property damage sustained by or through use of the equipment. Hirer may seek a fitness professional’s or a physician’s advice prior to use of any fitness equipment.
